A notice of non-compliance was issued to the approved provider for the following reasons:
Failure to comply with the requirements of Part 4.3 of the
Aged Care Act 1997. Specifically:

- In relation to keeping and retaining records relating to the service in accordance with paragraph 63-1(1)(a); and

- In relation to conducting, in a proper manner, appraisals under section 25-3, or reappraisals under section 27-5, of the care needs of care recipients provided with care through the Service in accordance with paragraph 63-1(1)(h).

Sanction or Notice to Agree applied Sanction or Notice to Agree applied The approved provider is not eligible to receive Commonwealth subsidies for any new care recipients at the service for a period of six (6) months.
 
Other requirements:
  • appoint, at its expense, an eligible adviser to assist it to comply with its responsibilities: in relation to care and series, governance and business operations. This appointment must be made by 5:00pm on 10 February 2021; and the adviser must be appointed for a period of at least six (6) months ceasing on 4 August 2021.
  • provide, at its expense, training for its officers, employees and agents as specified below and to demonstrate that it has provided that training.
This training should include, but not be limited to:
  • safe and effective clinical care and personal care including ongoing assessment and care planning, management of high impact or high prevalence risks, falls management, continence management and behavior management.
 
The Provider must provide a written training plan to the Commission by 17 February 2021 and written evidence of successful completion of the specified training by 4 August 2021.
 
  • participate in weekly teleconferences with the Commission and ensure a weekly written report is prepared and provided to enable the Commission to monitor the provider’s progress towards returning to compliance.
