Sanction or Notice to Agree applied Sanction or Notice to Agree applied In order to avoid the imposition of a revocation sanction under section 63N of the Aged Care Quality and Safety Commission Act 2018, the approved provider is required to agree to the following in writing by 5.00pm on 15 July 2022:
  • appoint, at its expense, an eligible adviser to assist them to comply with its responsibilities:
  • this appointment must be made by 5:00pm on 19 July 2022; and
  • the adviser must be appointed for a period of at least six (6) months ceasing on 13 January 2023.
  • Give the eligible adviser all the necessary information required to provide their assistance.
  • provide, at its expense, training for its officers, employees and agents as specified below and to demonstrate that it has provided that training.
    • This training should include, but not be limited to: care planning and documentation; assessment and review processes; risk mitigation for high impact, high prevalence risks; falls prevention and management; swallowing/choking management; oxygen management; pain management; wound management; continence management; clinical monitoring and response to clinical deterioration; management of restrictive practice; clinical oversight and governance.
    • The Provider must provide a written training plan to the Commission by 1 August 2022 and written evidence of successful completion of the specified training by 1 December 2022.
  • participate in regular teleconferences with the Commission and ensure a fortnightly written report is prepared and provided to enable the Commission to monitor the provider’s progress towards returning to compliance.
