A notice of non-compliance was issued to the approved provider for the following reasons
Failure to comply with the requirements of Part 4.3 of the
Aged Care Act 1997. Specifically:

- In relation to keeping and retaining records relating to the service in accordance with paragraph 63-1(1)(a); and

- In relation to conducting, in a proper manner, appraisals under section 25-3, or reappraisals under section 27-5, of the care needs of care recipients provided with care through the Service in accordance with paragraph 63-1(1)(h).

Outcome Outcome The Approved Provider has remedied the non-compliance.

A notice of non-compliance was issued to the approved provider for the following reasons
Failure to comply with the requirements of Part 3A.3 of the
Aged Care Act 1997.

Specifically:

Section 52N-1(1) and Section 52M-1(1) of the Act relating to the management of refundable accommodation deposits and accommodation bonds.

Outcome Outcome The Approved Provider has remedied the non-compliance.

- Revocation of approved provider status for a period of six months, unless the below conditions are undertaken
  • Appoint at their expense, an adviser to assist with complying with responsibilities in relation to care and services
  • Appoint at their expense, an administrator to assist with complying with responsibilities in relation to governance and business operation
  • To provide, at their expense, training for officers, employees and agents.

Reason(s) for sanction or notice to agree Reason(s) for sanction or notice to agree The department identified that there is an immediate and severe risk to the health, safety and wellbeing of care recipients at the service following information received from the Australian Aged Care Quality Agency. There were critical deficiencies at the service contributing to serious and detrimental failings in several areas including:

Accreditation Standard 3: Care recipient lifestyle

Current status of service Current status of service

The Department and the Quality Agency are continuing to monitor the service.

A residents and relatives meeting was held on 13/12/2018.
The adviser was appointed by the approved provider on 14/12/2018.
The administrator was appointed by the approved provider on 14/12/2018.


On 29 November 2018 the Department issued Sanctions to the Provider due to ongoing concerns identified at the service by the Aged Care Quality and Safety Commission in a review audit conducted between 20 and 27 November 2018.
